Terms of Service

1. Who we are

The Eternal Garden (oureternalgarden.com) is a hobby project run by Andras Gergely Csenteri, a private individual in Romania ("we", "us"). You can write to us at hello@oureternalgarden.com. We answer when we can, but we cannot promise a response time.

2. Agreeing to these terms

By ticking the boxes at checkout and paying, you agree to these terms and to our Privacy Policy. If you do not agree, please do not buy. You must be at least 18 years old to buy a garden.

3. The service

The Eternal Garden is a personal digital garden. For a one-time payment of $3.00 USD you get a garden code that opens your garden on any phone, tablet or computer. There is no account and no subscription. Your payment gives you access to your garden for as long as the service is running. Nothing on our website, in our emails or on the payment page promises that the service will last for any particular length of time. The service is provided as it is. It may change, have bugs or be unavailable at times, and we may add, change or remove features.

4. Your garden code

Anyone who has your code can open your garden, so keep it safe and share it only with people you trust. We are not responsible for what happens if you share or lose your code. If you lose it, you can have it emailed again from the recovery page, using the email address you gave at checkout, as long as the details you enter match our records. If you add another person's email address to your garden, you confirm that they know about it and agree to it.

5. Payment

Payments are handled by Stripe. The price is shown in US dollars and the amount at checkout is the full price. Your bank may add its own currency conversion fees. We may change the price for new purchases at any time. That never affects a garden you have already bought.

6. Immediate access and your right of withdrawal

Your garden is created and made available straight after your payment goes through. By ticking the second box at checkout, you asked us to create it immediately and you acknowledged that, once it has been created, you lose any right to withdraw from the purchase that the law gives consumers for digital content or services. This does not affect your other legal rights, for example if we fail to provide your garden or it does not work as described.

7. Refunds

Because your garden is created immediately, we do not refund a purchase once the garden has been created, except:

  • if we fail to provide your garden, or it does not work as described and we cannot fix it within a reasonable time;
  • where the law requires us to give a refund; or
  • if we close the service (see section 10).

We may choose to give a refund in other cases, but we do not have to. Refunds go back to the card you paid with.

8. Fair use

Please use the service for what it is made for. Do not try to break it, overload it, scrape it, reverse engineer it, copy it, guess other people's codes, or resell access to it. We may suspend or delete a garden that breaks these rules, and we owe no refund for it.

9. Our rights in the service

The service, including its design, code and artwork, belongs to us or our licensors. You get a personal, non-exclusive, non-transferable right to use your garden for yourself and the people you share your code with, for personal and non-commercial purposes only.

10. Changes to the service, and closing it

We hope The Eternal Garden keeps growing for many years, but it is a hobby project and we cannot promise that it will run forever. We may change or suspend parts of the service at any time. If we decide to close it for good, we will give you at least 30 days' notice, by email to the address you used at checkout and on this website, and your garden will keep working during that time. If we close the service, we will refund purchases made in the 60 days before closing. After the service closes, gardens can no longer be opened and we delete the data we hold.

11. Our responsibility to you

To the fullest extent the law allows, the service is provided as it is and as available. We do not promise that it will be uninterrupted or error-free, or that it will suit your purposes. We are not liable for indirect or consequential losses, for lost data, or for loss of enjoyment, and our total liability to you for anything connected with the service is limited to the amount you paid for it. We are not responsible for failures caused by things outside our control, such as outages at our payment, hosting, database or email providers, or internet failures. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud or intentional wrongdoing, or for anything else the law does not allow us to limit, and nothing in them affects the rights you have as a consumer that cannot be waived.

12. Changes to these terms

We may update these terms, for example when the service, the law or our providers change. We will post the new version here with a new date, and when a change matters to your rights we will also tell you by email. We keep a record of the version you accepted when you bought.

13. General

These terms are the whole agreement between you and us about the service. If a part of them cannot be enforced, the rest still applies. If we do not enforce a right straight away, we have not given it up. We may hand the project, and these terms, over to someone else who takes it on. You may not transfer your garden or your rights to anyone else, but sharing your code with people you trust is fine. These terms are written in English.

14. Governing law and disputes

These terms are governed by the laws of Romania, and disputes will be decided by the courts of Romania. If you are a consumer, you keep the mandatory consumer protections of the country where you live, and you may also bring a claim in the courts of your country if the law gives you that right.
